Strict Products Liability for Misrepresentation

Abstract
The American Law Institute is nearing completion of a new Restatement (Third) of Torts: Products Liability. A proposed final draft was published on April 1, 1997, and awaits final approval. While most sections in this restatement address the defectiveness theories of products liability, Section 9 addresses misrepresentation theories of liability. This article reviews that section.
